Terms and conditions of purchase and provision of the services offered by infocoche.net

1. Purpose

On the one hand, the provider of products and services, Óscar Ramírez Jiménez (hereinafter, Info Coche or the Provider), with Tax ID (NIF) 50.61.40.54 R, registered address at Alhama 58, Lucena, Córdoba (Spain), and contact email info@infocoche.net, owner of this Website, sets out the contractual document that governs the purchase of products and services through this Website.

On the other hand, the user/Customer (hereinafter the User), as a natural or legal person (as applicable), over whom they have authorisation and full responsibility for use and custody, and who is likewise responsible for the accuracy of the personal data provided to the Provider once any commercial or contractual transaction such as those described in these general conditions has taken place.

BOTH PARTIES ACCEPT this document, which means that the User:

• Has read and understands what is set out here.
• Is of legal age and has sufficient capacity to enter into contracts.
• Assumes all the obligations set out here and understands the rights they are entitled to.
• Has read and accepts these general conditions of purchase from the moment they acquire any product or service offered.
• Accepts the Privacy Policy and the Legal Notice on the Website, and agrees to pay the prices set out in these Conditions for the services purchased from Info Coche.

2. Description of the services. Features. How they work

• Feature: search by plate number – Obtains the approximate registration date, province and environmental badge. Info Coche is in no case responsible for the truthfulness or accuracy of the data provided, as it is not an official service but obtains the data from different sources.
• Feature: simple DGT report – Paid service. It is used to produce the "Incident Report", which shows the make, model, fuel and type of incidents at the date the information is requested.
• Feature: full DGT report – Paid service.
  • A DGT fee is paid, which is used internally and cannot be handed over to the customer.
  • Money is only refunded if the fee has not been used, and only the amount minus the handling costs, estimated at €4. This usually happens when the ID document, chassis number, plate number or a similar detail has been entered incorrectly.
  • If the system detects a malfunction while obtaining the information, an email is sent to the User and they will be contacted within the following 48 working hours to find a solution: a refund (minus handling costs) or a new request with the correct data.
  • The information stored for this service is what is needed to obtain a full report plus the invoicing information (tax name, full tax address, identity document, reason for the request, type of request and the email to which the document is sent).
  • By using this service, the User authorises the application (or its owner) to obtain the document using their data.
  • The report is sent to the User's email, and the User undertakes that the email and the data entered are valid, since they will be used to issue the invoices and to send the reports.
  • Info Coche is not responsible if the email is incorrect and the report is sent to the wrong address, and if the data entered is wrong it will not be changed on the invoices or on any document already issued.
  • Delivery is guaranteed within 30 minutes and will normally take a few seconds, provided that all services are operational, both internal (own servers) and external (DGT servers or those of other providers). The service is therefore guaranteed while the systems and all their components, including third-party components, are operational and fees are available.
• Feature: vehicle information by selecting a model – Obtains information about a vehicle by selecting the make, model, year and engine type.
• Feature: latest plate number issued – Daily update of the latest plate number found by the system; it is updated at most once a day.

All these features may be modified by Info Coche, with or without prior notice, in order to improve and develop the application, the website or the service offered.

3. The DGT report

3.1) As an extension of the previous point, this section sets out the information about the Report (whether the simple or the full option) obtained through the Info Coche service.

3.1.i) It is the document through which users can access information on the ownership of a vehicle, such as technical data, data on previous owners, administrative status (authorisation to circulate), validity of the roadworthiness inspection (ITV), fees or taxes, and charges or liens that could prevent the transfer of the vehicle, among others.

3.1.ii) The DGT Report is requested by providing the vehicle's plate number. Info Coche obtains the information listed in the previous point from the Vehicle Register of the Directorate-General for Traffic or the competent body, where applicable.

3.1.iii) Ordering the DGT Report:

• The User fills in the Report request form on the Info Coche website, having first accepted the corresponding data protection documentation and this document.
• Before this procedure, the User has access to information on the price of the available options in order to choose the one that suits their needs.
• If the User agrees with the price of the service and accepts these conditions, they are taken to a payment gateway to make the payment.
• Once the User has paid for the DGT Report, Info Coche processes it and sends the requested Report to the User by email.

3.1.iv) The DGT Report is delivered immediately, except in cases of force majeure or for reasons attributable to the DGT or other service providers (for example, the DGT's servers being down or an internal server malfunction).

3.1.v) Price: the total price of the Report is shown at the time of purchase, in its two versions: incident report (formerly called simple) and full report.

3.1.vi) The amount for this service is shown on screen, VAT included, and includes all costs, DGT fees and application services.

3.1.vii) The report is sent to the email address provided by the User. The User making the request is responsible for that address being legitimate and, by using the service, confirms that they have the necessary permissions and consents from the owner of that email for the Info Coche tool and email system to contact it, thus complying with data protection law when passing this email to a third party (Info Coche in this case). It is not Info Coche's responsibility to obtain this consent, as it acts as an intermediary.

4. Purchase of report packs from the web platform

The Info Coche web platform includes a feature to improve the user experience and make it easier to acquire reports.

This feature consists of buying packs of reports (called report credits) to be used on the platform itself, thus avoiding the added costs of repeated payments and the associated waiting times when requesting information.

4.1) Report packs can only be purchased from the web platform.

4.2.i) Pack prices are adjusted to each user profile, taking into account current legislation on Value Added Tax.

4.2.ii) Invoices issued by Info Coche carry no personal income tax (IRPF) withholding, including when the customer is a company, organisation or self-employed person.

4.2.iii) If the company, organisation or registered self-employed person is eligible for the reverse charge mechanism, it must indicate this in its profile and Info Coche will deduct the VAT, which the customer must then pay to the relevant authority itself.

4.2.iv) Invoices issued by Info Coche are created at the time of purchase and therefore reflect the customer profile provided in the "My profile" section of the platform; they cannot be changed afterwards, as they have already been issued.

4.3) Report credits can be used both on the web platform and in the mobile app, by signing in with the same account. Packs can only be purchased from the web platform (point 4.1).

4.4) A user who buys a pack of reports may only request a refund if they have not used any report from that pack.

4.4.i) Refunding the amount and the reports carries an administrative cost of €10 (plus VAT), which will not be refunded from the amount paid or which the customer will have to pay if the pack is worth less.

5. Affiliate programme

The Info Coche platform has an affiliate programme that rewards users who trust the product and support the project.

5.1) Affiliate links are unique and can be found in the "My profile" section of the web platform.

5.2) Each user created through the link provided by another user is recorded in order to potentially reward the user who shared the link.

5.3) The affiliate reward may change in the future, but is currently 3 incident reports, which are added to those already held by the user who shared the link.

5.4) The reward is added to the account of the user who shared the link once the new user has made their first payment for a report on the platform, and only the first time.

5.5) Each new user created through a link shared by a user can redeem a single reward, and only with the first purchase; it never applies to later purchases.

5.6) Info Coche reserves the right not to work with an affiliate user considered to be abusing this feature. A clear example would be creating fake user accounts to obtain free reports through the affiliate programme.

6. Access to the platform and the mobile applications

Info Coche is a free and public application, but reserves the right to allow or refuse the use of its tools when it considers appropriate.

In this respect, the following are unacceptable and will lead to a permanent denial of access for users who:

• Abuse any application (attempts to hack the platform, abusive use of the free features, etc.).
• Attempt fraudulent acts on the platform (unauthorised purchase of reports, payments with stolen cards, attempts to steal information, etc.).
• Pose as Info Coche to offer their services without permission.

7. Data protection

Specifically, together with the data protection section of the website, regarding the application and service offered by Info Coche, it is established that:

Search data, search histories and search behaviour are shared for anonymous data analysis and market research, both for Info Coche and for third parties.

The data offered in all the services comes either from the DGT itself or is approximate, with no responsibility for its accuracy, since the application never produces it; it only obtains it from different providers.

When emails are requested for the full reports or when users register, the user is understood to accept receiving informational, promotional and other emails. The user may unsubscribe (see our Privacy Policy).

8. Disclaimer

Info Coche is in no case responsible for the truthfulness, accuracy or completeness of the data provided (obtained free of charge or for a fee), as it is not an official information provider but obtains the data from different sources.

9. Vehicle technical data queries

Independently of the DGT Report, Info Coche offers a service to query a vehicle's technical data from its plate number, aimed mainly at companies and professionals and available from the web platform or through an API.

9.1) The service returns only technical data about the vehicle: chassis number, make, model, registration dates, fuel, emissions, whether it has valid insurance, whether it is temporarily de-registered and whether there are pending recalls. It does not include ownership, charges, liens, seizures, inspection history or mileage. That information belongs to the DGT Report, which is a different product with a different price.

9.2) Queries are purchased in packs. The price per query depends on the size of the pack purchased: the larger the volume, the lower the unit price.

9.3) Queries do not expire. While Info Coche keeps the service running, queries purchased and not used remain available in the user's account with no time limit.

9.4) Packs are not refundable, either in whole or in part. The unit price of each query is a direct result of the volume purchased, so partial use of a pack does not entitle the user to a proportional refund of the unused amount: the queries already used were enjoyed at the full-pack price, not at the price of a smaller pack.

9.4.i) As an exception, if Info Coche were to stop providing this service, compensation for purchased and unused queries will be assessed with each customer.

9.5) Repeating the same plate number within 24 hours of a query returns the information already obtained and does not use a new query. After that period, a new request for the same plate number uses a query and returns updated information.

9.6) The service depends on the availability of the official source register. When that register does not respond, requests are rejected without using queries from the user's balance. Info Coche does not guarantee uninterrupted availability of the service and is not liable for interruptions originating in the source register.

9.7) The data comes from the official register and is passed on exactly as provided, without modification. Point 8 of these Conditions applies regarding its truthfulness, accuracy and completeness.

9.8) API keys are personal to the account to which they are issued. The user is responsible for keeping them safe and for their use, including balance consumed by requests made with their credentials.

9.9) Purchasing a pack of queries implies express acceptance of this point 9.

10. Applicable law and jurisdiction

These conditions shall be governed and interpreted in accordance with Spanish law in all matters not expressly established herein. The Provider and the User agree to submit any dispute that may arise from the provision of the products or services covered by these Conditions to the Courts and Tribunals of the Provider's city, expressly waiving any other jurisdiction.
